Abstract

revolves around the rooting of human rights in the Islamic and Western human rights systems, and the statement of the origin of the right in each of them, while monitoring the joints of the human rights process historically in Islam and the West. The research took the terms of Imam al-Hassan A.A.'s reconciliation with Muawiyah as a starting point for the approach between the two visions to clearly show the precedence of Islam with its heavenly legislation, which is mentioned in the Holy Qur'an at times and in the sayings of the Prophet Al-Khatim (pbuh) and the people of his house (pbuh), their actions and reports, which is expressed in the purified Sunnah at other times. Al-Solh al-Hassani is a document that is more than fourteen centuries old, while Western human rights codifications are new, especially the most important of its universal documents, the Universal Declaration of Human Rights, adopted by the United Nations in  1948. Hence, the research began from the statement of the Islamic and Western visions through the approach between the products of the two human rights references and stood at the conclusion of the stability of the human right in Islam and preceded it not only at the level of legislation but also at the level of practice in other than one of the historical joints of the Islamic Ummah, especially in the era of the Prophet (pbuh) and then the era of the guardian (pbuh).  for you
